5.1 Limited Quantities
Certain products may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
5.2 Color and Image Accuracy
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. However, we cannot guarantee that your computer monitor’s display of any color will be accurate. Variations in lighting, monitor settings, and digital photography may result in differences between displayed images and actual artwork appearance. Condition reports are provided for select artworks and are based on visual inspection at the time of listing. These reports describe visible condition but do not constitute a warranty. Section 6 — Accuracy of Billing and Account Information
6.1 Order Acceptance
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

The pricing of artworks reflects this allocation of risk and limitation of liability.
Section 13 — Authenticity Representation and Disclaimer
13.1 Authentication Statement
All statements regarding authorship, attribution, origin, date, age, provenance, and condition are statements of opinion only, and not representations or warranties. No warranty is made that any artwork will be recognized as authentic by any third party or authority, including auction houses, museums, or other experts.
13.2 Expert Opinion Basis
Our authentication assessments are based on visual inspection and available documentation at the time of listing. Authentication represents our good-faith expert opinion only and is subject to change based on new information, scholarly research, or technical analysis.
13.3 Authentication Dispute Procedure
If you believe an artwork is not authentic, you must notify us in writing within 30 days of receipt with supporting documentation. We will review your claim in good faith. If we cannot reach agreement, either party may request an independent assessment by a mutually agreed-upon expert at the requesting party’s expense. The independent expert’s determination shall be binding on both parties.
13.4 No Warranty of Third-Party Recognition
Shōki Gallery makes no representation regarding whether any artwork will be accepted, authenticated, or recognized by any museum, institution, auction house, or other third party.
Section 14 — Indemnification
You agree to indemnify, defend, and hold harmless Shōki Gallery and its officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:
(a) Your use of the website or service; (b) Your violation of these Terms of Service; © Your violation of any applicable law or regulation; (d) Your infringement of any intellectual property right of any third party; (e) Your violation of any third-party right, including without limitation any right of privacy or publicity; or (f) Any claim that your content caused damage to a third party.

In the event that any provision of these Terms of Service is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such determination shall not affect the validity or enforceability of the remaining provisions hereof, which shall remain in full force and effect. Section 20 — Shipping and Delivery
20.1 Shipping Information

20.2 Risk of Loss
All sales are made FOB (Free on Board) shipping point. Title and risk of loss pass to the buyer upon delivery of the artwork to the carrier. We are not responsible for loss or damage occurring after the artwork is delivered to the carrier.
20.3 International Shipping
International buyers are responsible for all customs duties, import taxes, and other governmental charges. We are not responsible for delays or issues related to customs clearance.
Section 21 — Returns and Refunds
21.1 Return Window
Buyers may return artwork within 14 days of receipt for a full refund, provided the artwork is in the same condition as received and all original packaging is intact.
21.2 Return Eligibility
The following items are NOT eligible for return:
- Items marked as “Final Sale”
- Artwork damaged due to buyer negligence or mishandling
- Artwork that has been altered or modified
- Artwork returned after the 14-day window
21.3 Return Process
To initiate a return, contact us with your order number and reason for return. We will provide return shipping instructions. Artwork must be returned in original packaging. Return shipping costs are the buyer’s responsibility unless the return is due to our error or defective condition.
21.4 Refund Processing
Refunds are processed within 14 business days of receipt and inspection of returned artwork. Refunds are issued to the original payment method.
21.5 Pre-Purchase Disclosure
All return restrictions and final sale designations are clearly disclosed prior to purchase and are incorporated into the contract of sale.

Information related to accepted payment methods are made available during the purchasing process. All transactions are processed securely.
22.2 Payment Authorization
By submitting payment information, you authorize us to charge your payment method for the purchase amount plus applicable taxes and shipping.

If you initiate a chargeback with your credit card company or bank without first attempting to resolve the matter with us, we may:
(a) Suspend your account; (b) Refuse future orders; © Pursue legal action to recover the chargeback amount plus associated fees and costs.

All payment disputes must be reported to us within 30 days of the transaction date. Disputes reported after this period may not be eligible for resolution.

You acknowledge that artwork purchased through Shōki Gallery may be subject to cultural property laws, export regulations, import restrictions, and international treaties. You assume full responsibility for compliance with all applicable laws regarding the purchase, possession, transport, and export of cultural property in your jurisdiction and all jurisdictions through which the artwork will pass.
23.2 No Representation of Eligibility
Shōki Gallery makes no representation that any artwork is eligible for import or export under the laws of any jurisdiction. Buyers are solely responsible for obtaining any required permits, licenses, or approvals.
23.3 Restricted Items
Certain artworks may be restricted or prohibited from export or import under applicable law. We will disclose known restrictions at the time of listing, but you are responsible for verifying all applicable restrictions before purchase.
23.4 Buyer Indemnification
You agree to indemnify and hold harmless Shōki Gallery from any claims, fines, penalties, or legal action arising from your violation of cultural property laws or export regulations.
Section 24 — Limitation on Time to File Claims
You agree that any claim or cause of action arising out of or related to use of the website or these Terms must be filed within one (1) year after such claim or cause of action arises, or it shall be forever waived and barred.
